Acceptable Use Policy

BoostServ provides dedicated email infrastructure for legitimate business outreach. You are solely responsible for complying with every applicable law. Violation of this policy is a material breach and may result in immediate suspension or termination without refund.

01. Laws You Must Comply With

Depending on where you send from and where your recipients are located, one or more of the following laws apply. You are responsible for knowing and following them:

  • CAN-SPAM Act (United States) — include a valid physical postal address, honor opt-outs within 10 business days, no deceptive headers
  • CASL (Canada) — requires express or implied consent before sending commercial electronic messages
  • GDPR & ePrivacy (EU / UK) — lawful basis required to process personal data; clear opt-out in every message
  • DPDP Act, 2023 (India) — consent requirements for processing personal data of Indian residents
  • Spam Act 2003 (Australia) — requires consent and a functional unsubscribe mechanism
  • Any other anti-spam or data protection law applicable to you or your recipients

02. Prohibited Activities

You may not use the Service to:

  • Send to email addresses you have not legitimately sourced. Purchasing or scraping lists without verifiable consent (where required) is prohibited
  • Send phishing, fraud, malware, ransomware, or any content designed to deceive, steal credentials, or harm recipients
  • Impersonate another person, brand, company, or government entity. Do not spoof domains you do not own or control
  • Promote or facilitate illegal goods or services, including controlled substances, weapons, counterfeit goods, CSAM, human trafficking, stolen data, or unlicensed financial schemes
  • Send content that incites violence, hatred, or discrimination against any group
  • Fail to honor unsubscribe requests within the legally mandated window (typically 10 business days or less)
  • Omit a valid physical mailing address, sender identification, or unsubscribe mechanism where required by law
  • Send adult content, gambling promotions, or cryptocurrency schemes without disclosure
  • Attempt to bypass spam filters through obfuscation, encoding tricks, or image-only emails
  • Use the Service for activity that would require a license you do not hold

Zero tolerance for phishing, malware, and CSAM

We will immediately terminate accounts, cooperate with law enforcement, and preserve evidence without prior notice for any flagrant violation.

03. Infrastructure Requirements

Do not:

  • Remove, override, or misconfigure the SPF, DKIM, or DMARC records we set up for you
  • Attempt to relay mail through our infrastructure from unauthorized sources or other setups
  • Attempt to access, probe, or modify other customers' setups, IPs, or data
  • Run services other than email on your dedicated setup — no web hosting, proxies, VPNs, or crypto miners
  • Attempt to circumvent rate limits, security measures, or our authoritative nameservers

04. Sending Behavior

To protect your sender reputation and our IP range, you agree to:

  • Ramp up new IPs gradually. For the first 2–3 weeks, keep volume below 40 emails per mailbox per day and increase slowly
  • Keep hard bounce rate below 5%. Clean lists regularly. High bounces damage IP reputation for everyone in our range
  • Keep spam complaint rate below 0.1%. Sustained complaints above this threshold may trigger investigation and possible suspension
  • Honor unsubscribe requests immediately (at most within 24 hours)
  • Suppress recipients who have previously opted out, bounced, or marked your messages as spam
  • Send to business email addresses for B2B outreach; personal email carries higher legal risk and is your responsibility

05. Enforcement

If we receive abuse reports or detect violations, we may:

  • Contact you with a warning and request corrective action
  • Temporarily suspend sending until the issue is resolved
  • Permanently terminate your account without refund for serious or repeated violations
  • Cooperate with law enforcement, anti-abuse organizations (Spamhaus, SURBL), and ESPs when required
  • Preserve logs and evidence for legal proceedings

We may act on abuse reports without prior notice if the violation is flagrant (phishing, malware, CSAM) or if immediate action is required to protect our infrastructure and other customers.

06. Reporting Abuse

If you believe a BoostServ customer is violating this policy, email abuse@boostserv.io with:

  • The full email headers of the offending message
  • A copy of the message body
  • Your description of why you believe it violates this AUP

Response time: We investigate and respond to all abuse reports within 24 hours.
